TERMS AND CONDITIONS OF SALE

These conditions of sale (CGV) are concluded on the one hand by the company WHATIMISIT whose head office is located at CS 48756 58 rue de Monceau 75380 Paris Cedex 08, registered with the Registry of the Commercial Court of Paris under number RCS 927 610 725, hereinafter referred to as “WHATIMISIT” and managing the site https://whatimisit.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website https://whatimisit.com hereinafter referred to as “the buyer”.

ARTICLE 1: OBJECT

These general conditions of sale define the contractual relations between WHATIMISIT and the buyer, as well as the terms applicable to any purchase made on the site www.whatimisit.com

The acquisition of a product via this site implies unreserved acceptance of these general conditions of sale, which the buyer acknowledges having read before ordering.

Before any transaction, the buyer declares:

  • That the purchase of products on the site is strictly personal and not directly linked to a professional activity.

  • Have full legal capacity allowing him to enter into commitments under these T&Cs.

Modification of the General Terms and Conditions

WHATIMISIT reserves the right to modify these Terms and Conditions at any time to comply with any new regulations or improve the user experience. The applicable conditions will be those in effect on the date of the order.

Language of the T&Cs and interpretation
The information and general terms and conditions available on the French version of the Whatimisit website are the only ones legally binding. In the event of a discrepancy, error, or inconsistency with the English version, the French version shall prevail. No claims can be made based on a misinterpretation of the English translation.

ARTICLE 2. PRODUCTS OFFERED

The products available for sale are those presented on the WHATIMISIT website, subject to availability. WHATIMISIT reserves the right to modify the product range at any time.
Each product is accompanied by a description detailing its main technical characteristics. The photographs provided are as accurate as possible, but they are non-contractual and do not engage the Seller's liability.
The selection and purchase of a product are the sole responsibility of the customer.

ARTICLE 3. PRODUCT AVAILABILITY

Our offers are valid as long as they are displayed on our website and subject to stock availability. Information regarding product availability is provided for informational purposes only. A product is reserved only after payment has been confirmed. Until payment is made, the stock of the product(s) in question may change or even become unavailable.
In the event of a stock shortage or any other failure, WHATIMISIT reserves the right to cancel all or part of an order already paid and will refund the products in question.

Pre-sale
Pre-sale allows customers to purchase a product before its official launch, thus contributing to its financing and production.
The benefits of a pre-sale include:

  • A preferential rate in some cases, compared to the retail price after production.

  • The opportunity to directly support the manufacturer.

  • The opportunity to acquire an exclusive product, which may not be available after the pre-sale.

By confirming a pre-order, you agree to the specific conditions associated with this method of purchase, including extended delivery times that may vary, as well as possible minor adjustments to the final product and its packaging. The visuals and specifications of the watches offered for pre-order are provided for informational purposes only and cannot be considered contractually binding.
If a pre-order is refunded, bank transaction or payment processing fees may be deducted from the refunded amount.

ARTICLE 4. PRODUCT PRICES

Prices and Applicable Taxes

The prices displayed on the website are inclusive of all taxes (TTC) for deliveries within the European Union.

For deliveries outside the European Union, customs duties, import taxes, or other local fees may be required by the authorities of the destination country. It is the customer's responsibility to check with the relevant local authorities regarding any applicable tax or customs obligations.
These additional costs are in no way the responsibility of WHATIMISIT and are the sole responsibility of the customer, both in terms of declaration and payment.

The prices displayed do not include delivery charges, which are invoiced in addition to the total amount of the order. Delivery terms are detailed in Article 7 – Delivery.

WHATIMISIT reserves the right to modify its prices at any time. However, the price in effect at the time of the order will be the one applied to the buyer.

Prices may be adjusted without notice, either upwards or downwards. Any order constitutes acceptance of the prices displayed and the description of the products available for sale.

All orders are payable in Euros (€).

ARTICLE 5. ORDER AND PAYMENT TERMS

To ensure payment security and provide a worry-free shopping experience, WHATIMISIT implements the following measures:

  • Site protection against fraudulent attacks using artificial intelligence.

  • 3D Secure 2.0 authentication system for European card payments.

  • Payment processing complies with PCI security standards.

  • HTTPS/TLS encryption for secure transactions.
     

Orders are processed Monday through Friday (excluding public holidays) within 24 to 48 hours. Orders placed on weekends or public holidays will be processed the following business day.
Account Creation
Before placing an order, the buyer must create an account on the website www.whatimisit.com. The account creation button is accessible via the menu bar at the top of the site. During each visit, the buyer will be required to log in to view their account, verify their orders, or place a new order.​


Available Payment Methods
WHATIMISIT offers several secure payment options:

  • By credit card (Mastercard, Visa, AMEX, etc.). After validating the shopping cart and delivery address, shipping costs are calculated, and the buyer selects "Payment by credit card." Once the information has been verified and the Terms and Conditions accepted, the buyer confirms the order and is redirected to a secure interface to enter their banking information. Once payment is accepted, the order is registered, and the contract is formed. Payment by credit card is irrevocable.

  • By PayPal or PayPal Later (payment in 4 installments). The ordering process is similar to that for credit cards, with redirection to the secure PayPal interface. Payment via PayPal is irrevocable. In the event of cancellation or return, PayPal transaction fees will be charged to the customer and deducted from the refunded amount.

  • Payment via Google Pay. You can pay for your order quickly and without additional fees with Google Pay, using the credit cards registered on your account.

  • Payment via Apple Pay. A fast and secure way to pay with Apple Pay, using your bank cards saved in the Wallet app. Authentication via Face ID or Touch ID allows instant validation.

  • Payment via Alipay. For international customers, Alipay is available as a payment method. Fees may apply depending on the amount and the country of origin of the transaction.

  • By bank transfer. The buyer confirms their order and receives an order form. They must then transfer the money to WHATIMISIT's bank account, the details of which are provided. The order will be shipped within 2 business days of receipt of payment. Proof of transfer may be requested for product reservation.

  • By digital gift card. The buyer enters their unique gift card code on the payment page. If the order price exceeds the value of the card, they can pay the remaining balance using another payment method.
     

Order Confirmation
Confirmation of an order constitutes acceptance of these Terms and Conditions. All information provided and the recorded confirmation constitute proof of the transaction. WHATIMISIT will send an email confirmation to the buyer.
The buyer must verify the accuracy of the order and immediately report any errors. Any order constitutes acceptance of the prices and product descriptions.

Cancellation and Refusal of Orders
WHATIMISIT reserves the right to cancel or refuse an order in the event of a payment dispute with a customer or in the event of an obvious pricing error.

Ordering Specific Products
Some products offered by Whatimisit are personalized or specifically ordered based on customer requests. In accordance with Article L221-28 of the French Consumer Code, these items are not subject to the right of withdrawal.
Before confirming any order for a specific product, the customer acknowledges and accepts that it cannot be canceled, returned, or refunded, except with the express written consent of Whatimisit's customer service department.​

ARTICLE 6. RESERVATION OF OWNERSHIP

WHATIMISIT retains full ownership of the products sold until full payment has been received, including the principal amount, fees, and taxes.

ARTICLE 7. DELIVERY

Delivery costs are calculated during the ordering process and depend on the destination address, the value of the products, and the service chosen. Delivery times are indicated for informational purposes on the "My Cart" page when selecting the delivery method and location.
For all orders of €1,000 or less, delivery to a collection point via Colissimo, Mondial Relay or Relais colis is free in mainland France, offering a convenient and economical solution.

Delivery methods
Deliveries are made to the address provided by the customer when ordering, with package tracking and delivery against signature. Delivery is handled by our service providers:

  • Colissimo, Mondial Relay and relais colis: Monday to Saturday.

  • UPS: Monday to Friday (excluding public holidays and subject to payment validation).

For deliveries to a collection point via Colissimo or Mondial Relay, the package will be dropped off at the collection point closest to the customer's address, taking into account the most convenient hours.

 

In some cases, to optimize the availability and shipping of our watches based on their location, delivery may be handled by a different carrier. Since our watches can sometimes be shipped directly from the supplier, this adaptation allows us to guarantee fast and efficient shipping, while respecting the commitments made to our customers.


Delivery times and delays
Delivery times are given as an indication. If they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. Any amounts paid will be returned no later than fourteen days following termination, without compensation or deduction.
If the customer is absent at the time of delivery, a delivery note will be left by the carrier, allowing the ordered products to be collected or a new delivery to be rescheduled.

Transportation risks
Transportation risks are transferred to the buyer as soon as the items leave WHATIMISIT's premises. Upon delivery, the buyer is required to check the condition of the packaging and contents in the presence of the delivery person. If the packaging is damaged, open, or torn, the buyer must:

  • Check the condition of the items.

  • In case of damage, refuse the package and note a reservation on the delivery slip.

  • Record any anomalies (damage, missing product, damaged package, etc.) as handwritten reservations on the delivery slip and sign.

  • Confirm any complaints in writing within three (3) days of delivery.


Returned and Refused Packages
Any package returned to WHATIMISIT due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense. Packages refused by the recipient will not be refunded.

ARTICLE 8. RIGHT OF WITHDRAWAL AND RETURN

Whatimisit offers its customers extensive flexibility regarding cancellations. In accordance with Article L121-20 of the French Consumer Code, the law provides for a 14-day cancellation period from receipt of the order. However, Whatimisit goes beyond this legal requirement by offering a 30-day cancellation period.
During this period, the buyer may return their product for an exchange or refund, without penalty. However, delivery costs, payment fees (in certain cases), and any customs taxes (VAT, duties, etc.) remain the customer's responsibility.
Any return made after the 30-day period will not be eligible for a refund or exchange, unless prior written consent is obtained from customer service.

 

Return Conditions
The returned product must be complete, shipped to the address indicated by our customer service, in its original packaging, unworn, and in perfect aesthetic and functional condition. In the event of:

  • Missing items,

  • Irreversible signs of use,

  • Non-compliance with the provisions of Article L221-28 of the French Consumer Code,

The customer will be informed by email, and WHATIMISIT may refuse the return and return the item to the sender.

Delivery conditions for exchanges
When a customer exercises their right of withdrawal on an initial order benefiting from free delivery, the return shipping costs for the first watch remain the customer's responsibility. However, the shipping costs for the new watch sent in exchange are covered by Whatimisit. This free shipping service applies only once. Any new order after an initial exchange will be subject to the usual shipping costs.

 

Return, refund, and exchange conditions
To ensure customer satisfaction, we offer several options after validation of the return by our customer service:

  • Exchange: The item can be replaced with another, subject to availability.

  • Refund: Once the return is validated, the refund will be initiated within 48 hours using the payment method used for the purchase. The final delivery time will depend on the bank processing or payment platform.

  • Credit: A credit note valid on the website www.whatimisit.com may be issued.

Return Costs
Return shipping costs are the customer's responsibility. No cash on delivery shipments will be accepted.
WHATIMISIT does not cover customs duties associated with a customer return. If these duties are payable by WHATIMISIT, the amount paid will be deducted from the customer's refund.

 

Exclusion of the right of withdrawal for specific orders
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to the consumer's specifications or that are clearly personalized. Therefore, any product ordered at the customer's specific request, whether personalized or exclusively selected to meet the customer's expectations, cannot be returned or refunded unless specifically agreed in writing by Whatimisit's customer service department.
In the event a return request is made, no refund or exchange will be granted unless a prior arrangement has been made between the customer and Whatimisit.

ARTICLE 9. WATCH WARRANTY

All items sold by WHATIMISIT are covered by the legal guarantee of conformity and the warranty against hidden defects, in accordance with Articles L.217-4 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code.

 

Warranty Duration and Conditions
To assert their rights, the customer must notify WHATIMISIT in writing of the product's non-conformity within the following timeframes:

  • 24 months after delivery for a new product.

  • 12 months after delivery for a used product.

Depending on the case, WHATIMISIT will refund, replace, or repair the product under warranty.
If bringing the product into conformity is impossible or results in disproportionate costs, the refund will be made as soon as possible, and at the latest within 30 days of discovering the defect. The refund will be made by bank transfer.
Return shipping costs are the customer's responsibility; insured shipping is recommended.​


What the warranty covers
The warranty applies only to mechanical and manufacturing defects under normal use.
Warranty Exclusions
The warranty does not apply in the following cases: ❌ Defects or damage caused by an accident, improper handling, or misuse (shocks, impacts, crushing, etc.). ❌ Normal wear or aging of components (bracelets, cases, crowns, push buttons, crystals, etc.). ❌ Lack of regular maintenance or abnormal use of the watch. ❌ Damage related to magnetic fields or climatic conditions. ❌ Moisture infiltration into the case and oxidation phenomena. ❌ Non-compliance with the legislation of the country of delivery, which is the customer's responsibility. ❌ Use for professional purposes.​


Repair Conditions
Any repair of a watch purchased on www.whatimisit.com must be carried out by an authorized partner of the brand or by the manufacturer itself. Failure to do so will void the warranty.

ARTICLE 10. RESPONSIBILITY

In the context of distance selling, WHATIMISIT is bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, including:

  • Loss of data

  • Intrusion or unauthorized access

  • Viruses or cyberattacks

  • Service outages or other incidents beyond its control

     

ARTICLE 11. INTELLECTUAL PROPERTY

All elements present on the website www.whatimisit.com – including photos, logos, visuals, and text – are and remain the exclusive intellectual property of WHATIMISIT.
Any reproduction, exploitation, or use, even partial, of these elements, for any reason whatsoever, is strictly prohibited without prior authorization.

ARTICLE 12. PERSONAL DATA

WHATIMISIT is committed to maintaining the confidentiality of the information provided by the buyer when using its services.
Personal data is processed in accordance with the provisions of Law No. 78-17 of January 6, 1978, relating to information technology, files, and civil liberties.
As such, the buyer has the following rights regarding their information:

  • Access to their personal data.

  • Modification of their data.

  • Deletion of their information.

ARTICLE 13. DISPUTE RESOLUTION

These general terms and conditions of sale are subject to French law.
In the event of a dispute or litigation, only the French courts shall have jurisdiction.
