These terms and conditions of sale (T&Cs) are entered into between, on the one hand, the company WHATIMISIT, whose registered office is located at CS 48756 58 rue de Monceau 75380 Paris Cedex 08, registered with the Paris Trade and Companies Register under number RCS 927 610 725, hereinafter referred to as "WHATIMISIT" and operating the website https://whatimisit.com, and, on the other hand, any individual or legal entity wishing to make a purchase via the website https://whatimisit.com, hereinafter referred to as "the buyer".

 

ARTICLE 1. PURPOSE
These general terms and conditions of sale define the contractual relationship between WHATIMISIT and the buyer, as well as the terms applicable to any purchase made on the website www.whatimisit.com.
Purchasing a product via this website implies unreserved acceptance of these general terms and conditions of sale, which the buyer acknowledges having read before placing their order.

Before any transaction, the buyer declares:

That the purchase of products on the website is strictly personal and unrelated to any professional activity.

That they have the full legal capacity to enter into this agreement under these General Terms and Conditions of Sale.

Modification of the General Terms and Conditions of Sale
WHATIMISIT reserves the right to modify these General Terms and Conditions of Sale at any time, in order to comply with any new regulations or to improve the user experience. The applicable terms and conditions will be those in effect on the date of the order.

Terms and Conditions of Sale and Interpretation
The information and terms and conditions of sale available on the French version of the Whatimisit website are the only legally binding version. In the event of any discrepancy, error, or inconsistency with the English version, only the French version shall prevail. No claim may be based on a misinterpretation of the English translation.

ARTICLE 2. PRODUCTS OFFERED
The products available for sale are those presented on the WHATIMISIT website, subject to stock availability. WHATIMISIT reserves the right to modify the product range at any time.
Each product is accompanied by a description detailing its main technical characteristics. The photographs provided are as true to life as possible, but they are not contractual and do not constitute a guarantee by the Seller.

The choice and purchase of a product are the sole responsibility of the customer.

 

ARTICLE 3. PRODUCT AVAILABILITY
Our offers are valid as long as they are displayed on our website and subject to stock availability. Product availability information is provided for guidance only. A product is only reserved after payment for the order has been validated. Until payment is received, the stock of the product(s) in question may change or even become unavailable.
In the event of a stock shortage or any other issue, WHATIMISIT reserves the right to cancel all or part of an order that has already been paid for and will refund the cost of the products concerned.

Pre-sale
Pre-sale allows customers to purchase a product before its official launch, thus contributing to its financing and production.

The advantages of a pre-sale include:
A preferential price in some cases, compared to the retail price after production.

The opportunity to directly support the manufacturer.

The opportunity to acquire an exclusive product, which may not be available for sale after the pre-sale.

By placing a pre-order, you agree to the specific terms and conditions associated with this purchase method, including potentially longer delivery times and minor adjustments to the final product and its packaging. Images and specifications of watches offered for pre-order are for illustrative purposes only and are not contractually binding.
If a pre-order for a pre-ordered item is refunded, bank transaction or payment processing fees may be deducted from the refund amount.

 

ARTICLE 4. PRODUCT PRICES
Prices and applicable taxes
Prices displayed on the website are inclusive of all taxes (VAT included) for deliveries within mainland France.

Deliveries within the European Union
For new products, prices include VAT in the European Union country corresponding to the customer's delivery address.
The invoice details the price excluding VAT, VAT, and including VAT.

For used products, prices are established according to the VAT margin scheme, in accordance with Article 297 A of the French General Tax Code. In this context:

• VAT is calculated solely on the margin earned by the seller,

• it is not deductible for the buyer,

• it does not appear on the invoice,

• the invoice must include the following statement: "VAT not applicable – Article 297 A of the French General Tax Code – Margin scheme – Used goods". Deliveries to French Overseas Departments (Guadeloupe, Martinique, Réunion, French Guiana, Mayotte)
Deliveries to French Overseas Departments are invoiced excluding taxes. The invoice will state: "VAT Exemption – Article 294 of the French General Tax Code (CGI)." Local taxes, port duties, or import fees may be levied by local authorities. These fees are the sole responsibility of the customer.

Deliveries to French Overseas Territories (TOM) and outside the European Union
Deliveries to French Overseas Territories (TOM) and countries outside the European Union are invoiced excluding taxes. The invoice will state: "Export outside the EU – VAT not applicable." Customs duties, import taxes, or local fees may be applied by the authorities of the destination country. These fees are in no way the responsibility of WHATIMISIT and are the sole responsibility of the customer.

No VAT deduction for exports
For deliveries outside mainland France, the prices displayed on the website are not subject to VAT deduction, even when the order is shipped outside of France. The price paid by the customer corresponds to the displayed amount, excluding any local taxes applied upon arrival.

Delivery charges
The displayed prices do not include delivery charges, which are billed separately based on the total order amount. Delivery terms are detailed in Article 7 – Delivery.

Currency
All orders are payable in Euros (€).
Prices may be adjusted without notice, either upwards or downwards. Placing an order constitutes acceptance of the displayed prices and the description of the products available for sale.

 

ARTICLE 5. COMMERCIAL BENEFITS
Promotional Codes
Promotional codes issued by Whatimisit are valid only during the specified period and under the conditions detailed when they are provided.

They cannot be combined, transferred, or exchanged for cash.
Each code is strictly personal and reserved for the use of the customer for whom it is intended.
Whatimisit reserves the right to suspend or cancel any code in the event of improper or abusive use.

 

ARTICLE 6. ORDERING AND PAYMENT METHODS
To guarantee secure payments and offer a worry-free shopping experience, WHATIMISIT implements the following measures:

• Website protection against fraudulent attacks using artificial intelligence.

• 3D Secure 2.0 authentication system for payments made with European cards.

• Payment processing compliant with PCI security standards.

• HTTPS/TLS encryption for secure transactions. Orders are processed Monday through Friday (excluding public holidays) within 24 to 48 hours. Orders placed on weekends or public holidays will be processed the next business day.
Account Creation
Before placing any order, the buyer must create an account on the website www.whatimisit.com. The account creation button is accessible via the menu bar at the top of the website. On each visit, the buyer must log in to view their account, check their orders, or place a new order.

Available Payment Methods
WHATIMISIT offers several secure payment options:

• By credit card (Mastercard, Visa, AMEX, etc.). After validating the shopping cart and delivery address, shipping costs are calculated, and the buyer selects "Credit Card Payment." Once the information is verified and the Terms and Conditions are accepted, the buyer confirms the order and is redirected to a secure interface to enter their bank details. Once the payment is accepted, the order is registered, and the contract is formed. Payment by credit card is irrevocable.

• Via PayPal or PayPal Later (4-installment payment). The ordering process is similar to that of credit card payments, with redirection to the secure PayPal interface. Payment via PayPal is irrevocable. In case of cancellation or return, PayPal transaction fees will be charged to the customer and deducted from the refunded amount.

• Payment via Klarna. Depending on your eligibility, several options may be offered: - Deferred payment for 30 days, allowing you to pay for your order after shipment, free of charge if paid on time. - Payment in 3 installments with no fees, up to a maximum of €1,500, with three monthly installments automatically debited. - Immediate payment, via payment methods registered with Klarna. Using Klarna implies acceptance of their terms and conditions. Klarna may conduct a credit check to determine access to the different payment options.

• Payment via Google Pay. You can pay for your order quickly and without additional fees using Google Pay, with the bank cards saved to your account.

• Payment via Apple Pay. A fast and secure way to pay with Apple Pay, using your bank cards saved in the Wallet app. Authentication via Face ID or Touch ID allows for instant validation.

• Payment via Alipay. For international customers, Alipay is available as a payment method. Fees may apply depending on the amount and the country of origin of the transaction.

• By bank transfer. The buyer confirms their order and receives an order confirmation. They must then transfer the funds to WHATIMISIT's bank account, the details of which are provided. The order will be shipped within 2 business days after receipt of payment. Proof of transfer may be requested to reserve the product.

• By digital gift card. The buyer enters the unique code of their gift card on the payment page. If the order price exceeds the value of the card, they can pay the remaining balance using another payment method. Order Confirmation
Confirming an order implies acceptance of these Terms and Conditions. All data provided and the recorded confirmation constitute proof of the transaction. WHATIMISIT will send an email confirmation to the buyer.
The buyer must verify the accuracy of the order and report any errors immediately. Placing an order constitutes acceptance of the prices and product descriptions.

Order Cancellation and Refusal
WHATIMISIT reserves the right to refuse or cancel any order without having to provide a reason, particularly in the event of an existing or prior dispute with the Customer, payment default or incident, suspected fraud, a clear error in the price or product description, product unavailability, or for any other legitimate reason.

In this case, the customer will be informed as soon as possible and the order will be fully refunded.

Ordering Specific Products
Some products offered by Whatimisit are personalized or ordered specifically according to the customer's requests. In accordance with Article L221-28 of the French Consumer Code, these items are not subject to the right of withdrawal.

Before confirming any order for a specific product, the customer acknowledges and accepts that it cannot be canceled, returned, or refunded, except with the express written agreement of Whatimisit's customer service department.

ARTICLE 7. RETENTION OF TITLE
WHATIMISIT retains full ownership of the products sold until full payment of the price, including the principal amount, fees, and taxes, has been received.

 

ARTICLE 8. DELIVERY
For all orders shipped within mainland France, delivery is free, fast, and secure.

For deliveries to other countries, fees apply and are calculated automatically during the ordering process, based on the address, the value of the products, and the chosen delivery method.

Estimated delivery times are always indicated on the "My Cart" page when selecting the delivery method and location.

Delivery Methods
Deliveries are made to the address provided by the customer during the ordering process, with package tracking and signature confirmation upon delivery. Deliveries are handled by our service providers:

• Colissimo or Mondial Relay: Monday to Saturday.

• UPS or FedEx: Monday to Friday (excluding public holidays and subject to payment validation).
For deliveries to a pickup point (for items valued at €250 or less) made via Colissimo, Mondial Relay, or Relais Colis, the package is delivered to the pickup point closest to the address provided by the customer, taking into account the availability and opening hours of the pickup point.
In some cases, to optimize the availability and shipping of our watches based on their storage location, delivery may be handled by another carrier. Since our watches can sometimes be shipped directly from the supplier, this adjustment allows us to guarantee fast and efficient shipping, while respecting our commitments to our customers.

Delivery Times and Delays
Delivery times correspond to the time required for the order to be prepared and shipped to the address provided by the customer. They are communicated at the time of ordering and may vary depending on logistical conditions and the chosen shipping service. These delivery times are indicative only. If delivery exceeds thirty days from the date of the order, the sales contract may be cancelled and the buyer refunded. Payments made will be refunded no later than fourteen days following cancellation, without compensation or deductions.

If the customer is absent at the time of delivery, a delivery notice will be left by the carrier, allowing the customer to collect the ordered products or reschedule delivery.

Risks related to transport
The risks related to transport are transferred to the buyer as soon as the items leave WHATIMISIT's premises. Upon delivery, the buyer is required to check the condition of the packaging and contents in the presence of the delivery person. If the packaging is damaged, open, or torn, the buyer must:

• Check the condition of the items.

• In case of damage, refuse the package and note this on the delivery slip. • Record any anomalies (damage, missing product, damaged package, etc.) as handwritten remarks on the delivery slip and sign it.

• Confirm any claim in writing within three (3) days of delivery.

Returned and Refused Packages
Any package returned to WHATIMISIT due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense. Packages refused by the recipient will not be eligible for a refund.

ARTICLE 9. RIGHT OF WITHDRAWAL AND RETURNS
Return Policy – ​​30-Day Peace of Mind
At Whatimisit, each watch is carefully selected and designed to last.

We understand that such a choice sometimes warrants additional consideration.

That's why we offer you a 30-day peace of mind period, allowing you to confirm your decision with complete confidence.

Legal Right of Withdrawal
In accordance with applicable legal provisions, the Customer has fourteen (14) calendar days from the date of receipt of their order to exercise their right of withdrawal, without having to provide a reason.

Any product returned within this period, strictly in its original condition, complete and with all accessories, will be fully refunded, according to the terms and conditions set out in these General Terms and Conditions of Sale.

Whatimisit Extended Return Policy – ​​Up to 30 Days
As a purely commercial gesture, Whatimisit extends the return period until the 30th day following receipt of your order.
Returns made between the 15th and 30th days will result in the issuance of a credit note, usable on the entire Whatimisit.com website.
To benefit from this extension, the watch must be unworn, unused, and returned in the exact same condition as when it was delivered, with all its protective packaging, accessories, and documentation.
This extension is solely intended to give you time to confirm your choice, without ever compromising the integrity of the carefully selected pieces we offer.

Return Conditions
When exercising your legal right of withdrawal or taking advantage of the extended return policy offered by Whatimisit, products must be returned to the following address: 58 rue de Monceau, 75008 Paris, in the same condition as when they were delivered.

Before returning any item, you must contact our customer service department to obtain prior approval and return instructions. This step ensures prompt, secure processing in accordance with our internal procedures.
Any return made without prior notification or sent to an address other than the one provided cannot be processed within the usual timeframe. In this case, Whatimisit cannot be held responsible for any delay, inability to process the return, loss, or delivery error. The processing time may be extended until the package is received.

Watches must be:

• complete, with all items included in the original shipment (case, protective materials, strap, documentation, warranty card if applicable),

• returned in their original packaging,

• tried on only, as in a boutique fitting, and under no circumstances used, worn for extended periods, or tested in real-world conditions,

• in perfect aesthetic and functional condition, without any signs of wear, impact, scratches, excessive handling, or alteration of any kind. Exclusions and Reservations
In particular, in the event of:

• missing parts or components,

• signs of use or wear, even slight,

• failure to comply with the conditions stipulated in Article L221-28 of the French Consumer Code,
Whatimisit reserves the right, after examining the product and assessing its residual value, to:

• refuse the return, or

• apply a discount and issue a partial refund, strictly proportional to the observed loss in value.

The Customer will be informed of this decision by email, accompanied, where applicable, by the supporting documentation for the assessment.

Delivery Conditions in Case of Exchange
When a Customer exercises their right of withdrawal on an initial order that benefited from free delivery, the return shipping costs for the first watch remain entirely their responsibility.

In the case of an exchange, Whatimisit will cover the shipping costs of the replacement watch, as a courtesy and for a single exchange only. This service is strictly limited to one exchange per order. Any new order or additional exchange will be shipped according to the delivery rates in effect at the time of the order.

Refund, Exchange, and Credit Terms
To ensure customer satisfaction, we offer several options after the return has been validated by our customer service department:

• Exchange: The item can be replaced with another, subject to availability.

• Refund: Once the return is validated, the refund will be initiated within 48 hours using the original payment method. The final processing time will depend on the bank or payment platform. In accordance with Article L. 221-24 of the French Consumer Code, Whatimisit will reimburse the customer in full.

 

ARTICLE 10. WATCH WARRANTY
All items sold by WHATIMISIT are covered by the legal guarantee of conformity and the guarantee against hidden defects, in accordance with Articles L.217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.
Duration and conditions of the guarantee
To exercise their rights, the customer must inform WHATIMISIT in writing of the product's non-conformity within the following timeframes:

• Within 24 months of delivery for a new product.

• Within 12 months of delivery for a used product.

Depending on the case, WHATIMISIT will repair, replace, or refund the product under warranty.

If bringing the product into conformity is impossible or would result in disproportionate costs, a refund will be issued as soon as possible, and at the latest within 30 days of the defect being discovered, by bank transfer.

Return shipping costs are the responsibility of the customer; insuring the shipment is recommended.

What the warranty covers
The warranty applies only to mechanical and manufacturing defects under normal conditions of use.

Warranty exclusions
The warranty does not apply in the following cases: ❌ Defects or damage caused by accident, improper handling, or misuse (shocks, impacts, crushing, etc.). ❌ Normal wear and tear or aging of components (straps, cases, crowns, pushers, crystals, etc.). ❌ Lack of regular maintenance or abnormal use of the watch. ❌ Damage related to magnetic fields or climatic conditions. ❌ Moisture infiltration into the case and oxidation. ❌ Failure to comply with the legislation of the country of delivery, which is the customer's responsibility. ❌ Use for professional purposes.

Repair Conditions
Any repair of a watch purchased on www.whatimisit.com must be carried out by an authorized partner of the brand or by the manufacturer itself. Otherwise, the warranty will be void.

ARTICLE 11. LIABILITY
In the context of distance selling, WHATIMISIT is bound by an obligation of means. It cannot be held liable for damages resulting from the use of the Internet, including but not limited to:

• Data loss,

• Intrusion or unauthorized access,

• Viruses or cyberattacks,

• Service interruptions or other incidents beyond its control.

 

ARTICLE 12. INTELLECTUAL PROPERTY
All elements present on the website www.whatimisit.com – including photos, logos, visuals, and texts – are and remain the exclusive intellectual property of WHATIMISIT.
Any reproduction, exploitation, or use, even partial, of these elements, for any reason whatsoever, is strictly prohibited without prior authorization.

ARTICLE 13. PERSONAL DATA
WHATIMISIT is committed to preserving the confidentiality of information provided by the buyer when using its services.
Personal data is processed in accordance with the provisions of French Law No. 78-17 of January 6, 1978, concerning information technology, data files, and civil liberties.
As such, the buyer has the following rights regarding their information:

• Access to their personal data.

• Modification of their data.

• Deletion of their information.

ARTICLE 14. DISPUTE RESOLUTION
